This document details the standard terms and conditions covering engagement with Kierstone Limited, either directly, or through the website and/or social media platforms used by Kierstone Limited. Where there is conflict between these Terms and Conditions and those specified in contractual agreements, this document will be superseded by the signed agreement.
PAYMENT
Upon entering a commercial relationship, a formal statement of work, commercial contract or letter of engagement will be issued by KIERSTONE LIMITED. Upon the signing of this agreement by both parties, the customer is responsible to processing timely payments in accordance with the agreement. A payment can be made by Visa, Visa Electron, MasterCard, Delta, and Maestro debit cards and any other methods which may be advertised on the Website from time to time. Payment will be invoiced upon confirmation of the completion of deliverables or milestones as specified in the agreement by KIERSTONE LIMITED. It is agreed that the invoice is debited and cleared from the customer bank account within the payment terms as specified in the agreement.
You confirm that the bank account details shared with KIERSTONE LTD are correct, are rightfully owned by the customer’s company, and that as the customer representative have you have been specifically authorized by the customer’s company to use it. All credit/debit card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment refuses to authorize payment, or there are any delays of payment to KIERSTONE LIMITED (in accordance with the payment terms specified in the agreement), we will not be liable for any delay or non-delivery. We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your engagement and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide either through email or when accessing the Website.
INTELLECTUAL PROPERTY RIGHTS
Your use of the Website and its contents grants no rights to you in relation to any copyright, designs, trademarks and any other intellectual property and material rights relating to the Content (as described in the Content section below), including KIERSTONE LIMITED Software and/or Services and all HTML and other code contained in this Website.
